I. Scope of Application, Contractual Elements

(1) These General Terms and Conditions (hereinafter referred to as GTC) apply to the contractual relationship between Flughafen Bremen GmbH (hereinafter referred to as FBG) and the Customer with regard to the booking, administration, modification and cancellation of parking products via FBG's online booking system https://www.bremen-airport.com/am-flughafen/anreise-parken/parken/. The version of the GTC valid at the time of the conclusion of the contract shall be authoritative.

(2) In addition, the respectively valid parking conditions for multi-storey car parks and open spaces, which are published in FBG's parking facilities, shall be an integral part of the contract.

II Booking and conclusion of contract, booking for third parties

(1) The provision of the online booking system does not constitute a legally binding offer by FBG, but merely a non-binding invitation to the customer to submit an offer to conclude a contract for the booking of a parking product in accordance with the following GTC.

(2) The customer enters the data required for the conclusion of the contract, including the data required for invoicing, into the online booking system. In the booking process, the parking products available for the selected period (entry and exit date as well as entry and exit time) are displayed to the customer. Only one parking product can be booked per booking process. Bookings can be made from 2 hours up to 12 months in advance depending on the parking product.

(3) By clicking the "Buy now" button, the customer makes a binding and irrevocable offer to conclude a contract for the booking of a parking product. After successful payment, a booking confirmation is generated in the booking process. In addition, the customer receives the booking confirmation by e-mail to the e-mail address specified in the booking process. The contractual relationship between FBG and the customer comes into effect upon receipt of the booking confirmation.

(4) The booking confirmation shall contain the following data: Booking number, booked parking product, parking tariff, booked car park, entry date/time, exit date/time and the total amount. The data stated on the booking confirmation are a binding part of the contract.

(5) The customer is obliged to check the receipt of the booking confirmation and, if necessary, to request a new booking confirmation if the customer has not received a booking confirmation. The customer is also obliged to check the booking confirmation for correct data and, if necessary, to change it in accordance with these GTC.

(6) In addition to the booking confirmation, the customer receives the invoice and the e-ticket with the QR code as a means of identification for entry and exit. The data can be downloaded by the customer immediately after the successful booking or taken from the confirmation e-mail.

(7) Commercial booking of parking products for third parties or their subcontracting or subletting is not permitted.

III. Performance obligations of the contracting parties

(1) Upon conclusion of the contract, the customer acquires the right to park his passenger car once at the conditions stated in the booking confirmation. FBG undertakes to provide the customer with a parking space at the conditions stated in the booking confirmation.

(2) No fixed parking space shall be allocated. There is free choice of parking space in all parking spaces in the selected multi-storey car park that are not designated as permanently rented due to signage.

(3) If the booked parking product is not available due to special events, FBG undertakes to offer the customer an alternative location without a separate fee or to cancel the booking free of charge. Any amounts overpaid shall be refunded to the customer.

IV. Payment and voucher

(1) The invoice amount for the parking product must be paid immediately upon booking. Without completed payment of the desired parking product, a conclusion of the contract is not possible, so that no booking confirmation is generated.

(2) The legally valid value added tax is to be paid. The invoice amount is shown on the invoice including (gross) and excluding (net) the legally valid value added tax at the time of the booking or change.

(3) Vouchers must be entered in the designated input field using the voucher code printed on the voucher before submitting the non-binding offer of a booking request. Vouchers must be applicable to the selected parking product. It is not possible to take voucher codes into account after the booking request has been sent. Payment of vouchers is excluded.

V. Booking management

(1) The booking is made as a guest user or as a registered user.

(2) If the booking is made as a guest user, the user can only manage the respective booking by entering the booking number and the e-mail address given at the time of booking. If the booking is made as a guest booking, it cannot be subsequently managed via a customer account.

(3) Customers have the option of using a customer account to book, manage, change or cancel all bookings made by the customer - with the exception of bookings as a guest user. The customer account is accessed by means of an e-mail address and a self-determined password. In the case of a booking via a customer account, individual fields are pre-filled from the second booking onwards. The personal data, in particular the pre-filled fields, must be checked by the customer during each booking process and corrected if necessary.

VI. Modification of the booking

(1) A change to the booking is possible until the booking request is sent.

(2) After the booking request has been sent, the car park, the parking product, the entry and exit date as well as the entry and exit time can be changed free of charge up to two hours before the booked entry, depending on availability. The time of receipt of the change declaration by FBG is decisive. Later changes cannot be taken into account.

(3) Changes to the booking may result in an additional payment or refund. The difference must be confirmed again by entering the credit card or bank details for payment of the additional payment amount or the refund amount.

(4) The customer will receive a new booking confirmation, a new invoice or, in the case of a refund, a credit note and a new e-ticket in the booking process or by e-mail. The documents generated during the previous booking or booking confirmation lose their validity upon receipt of the aforementioned documents.

(5) The basis for the additional payment or refund in the event of a change of booking is the parking tariff already booked.

(6) Vouchers may also be used in the event of a change to a booking, provided that the desired parking product is available, the voucher is applicable to the parking product and the voucher remains valid on the basis of the conditions stated on the voucher.

(7) It is not possible to change the billing address and the payment method subsequently.

VII Cancellation of the booking, refund and voucher

(1) A cancellation is possible up to two hours before the booked entrance free of charge or for a cancellation fee. The time of receipt of the cancellation declaration by FBG is decisive. Later cancellations cannot be considered.

(2) If the booking is cancelled, the refund amount including the VAT paid minus the aforementioned cancellation fee shall be automatically credited back to the form of payment selected at the time of booking. The basis for the refund amount is the parking tariff of the parking product at the time of booking.

(3) The customer will receive a cancellation confirmation and a credit note in the booking process or by e-mail.

(4) The voucher code used for the booking can be used again after a cancellation under the conditions stated on the voucher.

(5) Cancellations less than one hour and before the entry time stated on the booking confirmation are only free of charge in the event of force majeure, such as flight cancellations due to strikes, terrorism or natural disasters. A refund is excluded unless the customer can prove that FBG has suffered a lesser loss.

VIII Entry and exit

(1) Entry and exit to the booked car park are exclusively via a QR code. The e-ticket with a QR code can be called up and used in printed form or on a mobile device. If the customer does not have the QR code included in the booking confirmation with him/her when entering or exiting the car park or if the QR code cannot be used, the customer must contact the information desk in Terminal 1 before entering or exiting the car park.

(2) When the QR code is used, a parking ticket is additionally generated from the barrier system. This parking ticket must be taken from the column in front of the barrier and kept until exit. Payment for this parking ticket must not be made again.

(3) Entry and exit is possible during the period stated on the booking confirmation. Deviations within the specified period are possible at any time. FBG shall not be liable to refund any parking fee already paid if the parking period is not observed.

(4) If the customer exceeds the specified period, a separate charge will be levied according to the barrier tariff applicable at the time of entry. The fee is payable at the information desk in Terminal 1.

(5) In the event that the customer does not enter the booked car park, no parking fee shall be refunded to the customer unless the customer can prove that FBG has suffered a lesser loss.

IX. Data Protection

FBG processes personal data in the context of booking a parking product in FBG's online booking system. Please refer to the data protection declaration on the FBG homepage https://www.bremen-airport.com or in the booking process.

X. Liability

(1) FBG shall be liable without limitation for all damage caused by FBG in the event of intent or gross negligence.

(2) In the event of slight negligence, FBG shall have unlimited liability in the event of injury to life, limb or health.

(3) Otherwise, FBG shall only be liable insofar as FBG has breached a material contractual obligation. In this context, essential contractual obligations are defined in the abstract as obligations the fulfilment of which is a prerequisite for the proper performance of the contract and the observance of which the customer may regularly rely on. In these cases, liability is limited to compensation for the foreseeable, typically occurring damage.

(4) Insofar as FBG's liability is excluded or limited in accordance with the aforementioned provisions, this shall also apply to FBG's vicarious agents. FBG shall not be liable for the actions of third parties.

(5) FBG assumes no liability - with the exception of the provisions in Section VII, paragraph 6 of these GTC - for cases of force majeure and other obstructions, e.g. blockades of the barrier system by other users. In such cases, FBG is not obliged to offer the Customer an alternative parking space at the booked conditions or to cancel the reservation.

XI. Other provisions

(1) The place of jurisdiction in commercial legal transactions shall be Bremen (city of Bremen courts). The place of performance is Bremen.

(2) The provisions of the Federal Republic of Germany shall apply exclusively to this contract.

(3) In the event of a translation of these contractual terms and conditions, only the German version shall remain legally binding.
